1. Initial Resolution
1.1. If you have a dispute regarding a product, service, or transaction with Siigma Air Conditioners, you must first contact our customer service team at [info@siigmaaircon.in ] to attempt to resolve the issue informally.
1.2. Our customer service team will acknowledge receipt of your complaint within fifteenth business days and will endeavor to provide a resolution within thirty business days.
2. Escalation to Management
2.1. If the dispute cannot be resolved through our customer service team, it will be escalated to our management team.
2.2. You will receive an acknowledgment from the management team within seven business days of escalation.
2.3. The management team will review all relevant information and documents related to the dispute and will aim to provide a resolution within ten business days of acknowledgment.
3. Mediation
3.1. If the dispute remains unresolved after escalation to the management team, either party may propose mediation as a means to resolve the issue.
3.2. Mediation will be conducted by a neutral third-party mediator mutually agreed upon by both parties.
3.3. The costs of mediation will be shared equally between Siigma Air Conditioners and the customer unless otherwise agreed upon.
4. Arbitration
4.1. If mediation does not resolve the dispute, the matter will be settled by binding arbitration.
4.2. The arbitration will be conducted in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996.
4.3. The arbitration will take place in the city where Siigma Air Conditioners is headquartered, unless otherwise agreed upon.
4.4. Each party will bear its own costs and fees for the arbitration, except as may be provided by the rules or the arbitrator’s decision.
5. Governing Law
5.1. This Dispute Resolution Policy is governed by the laws of India, without regard to its conflict of laws principles.
6. Finality of Decision
6.1. The decision of the arbitrator will be final and binding on both parties.
6.2. Judgment on the arbitration award may be entered in Mumbai jurisdiction.
7. Confidentiality
7.1. All discussions and documents related to the dispute resolution process, including mediation and arbitration, will be confidential and will not be disclosed to any third parties except as required by law.
